This revision petition is against the order dated 25.2.2022 passed by the Sub Divisional Judicial Magistrate, directing the payment of interim maintenance of Rs.7000/- per month under Section 23 of the Protection of Women from Domestic Violence Act, 2005, and also the order dated 13.9.2022, passed by the Additional Sessions Judge, upholding the grant of interim maintenance.

Learned counsel for the petitioner has contended that the amount of maintenance granted is on a higher side as he is working merely as a Commission Agent in the Grain Market, Punhana, District Nuh. 3.
Perusal of the impugned orders show that averments regarding the petitioner being a Commission Agent, owning a grocery shop and earning Rs. 2.5 lakhs per month, have simply been denied by him in the written statement, without giving any specific reply as to how much he is earning or what is his vocation. A certified copy of the petition filed by the petitioner/husband under Section 13 (1A) of the Hindu Marriage Act, 1955, was also placed on record before the trial Court, wherein he had claimed himself to be a businessman, ASHWANI KUMAR 2023.02.24 17:27 I attest to the accuracy and integrity of this document

Keeping in view the aforesaid facts and bald denial to the averments, the trial Court awarded the interim maintenance of Rs.7000/- per month to the respondent/ wife, which cannot be considered on a higher side. The impugned orders are well reasoned and based on relevant considerations. 6.
Dismissed.
