(Oral) The present revision petition has been filed under Article 227 of the Constitution of India impugning order dated 17.08.2022 passed by the Motor Accident Claims Tribunal, SAS Nagar (Mohali). Learned counsel for the petitioners, at the outset, states that the petitioners do not wish to examine Amarjit Singh or the concerned witness who have been summoned vide application dated 15.04.2021 with the medical record of Amarjit Singh. He, however, prays that one effective opportunity may be granted to them to complete the evidence of Amritpal Singh i.e. petitioner no.1 himself.

Learned counsel for the petitioners would further contend that given one effective opportunity, the petitioners would close their entire evidence and there would be no further delay on their part. Per contra learned counsel for respondent no.1 has contended that deliberate efforts have been made by the petitioners to delay the entire proceedings since respondent no.2-Insurance Company has disputed the insurance policy produced by them.

CR No.4423 of 2022 -2Learned counsel for respondent no.2-Insurance Company has also contended that deliberate efforts have been made to delay the proceedings.

Heard.

In the present case though there have been repeated efforts on the part of the petitioners to unnecessarily delay the proceedings, however, in the interest of justice, one effective opportunity is granted to the petitioners to complete the evidence of the petitioner herein. It is made clear that no further opportunity shall be granted to them. The opportunity for leading their evidence is subject to the payment of Rs.30,000/- as costs to be paid to respondent no.1.

Since the accident pertains to the year 2018, the Tribunal is requested to expedite hearing of the matter.

The present revision is disposed off in the above terms. Pending applications, if any, also stand disposed off.
