Mr. Karan Kaushal, Advocate for applicant-appellant. ***** Prayers made in the applications are for recalling of order dated 08.08.2023 seeking modification thereof. A perusal of order dated 08.08.2023 shows that the appeals were disposed of in terms of order dated 01.06.2023 passed by this Court in RERA-APPL-65 to 67-2023 while granting the same relief to the appellant.

I have heard learned counsel for the applicant-appellant and gone through the contents of application. For the reasons mentioned in the applications, the same are allowed.

Although, the present appeals were disposed of in terms of judgment dated 01.06.2023 passed in RERA-APPL-65 to 67-2023, however, no cost was imposed in the present appeals for the reason that no recovery certificate and writ of demand by the Tehsildar was ever issued against the present appellant.

In view thereof, the order dated 08.08.2023 is modified to the extent that though, the appeal shall remain disposed of in terms of decision dated 01.06.2023 passed in RERA-APPL-65 to 67-2023, however, subject to no cost.

CMs stand disposed of.
