Through the instant petition, as instituted under Section 528 of the B.N.S.S., 2023, the petitioner seeks quashing of the order dated 21.08.2024 (Annexure P-7), wherethrough, the learned Special Judge, C.B.I. Court, Chandigarh, has dismissed his application (Annexure P-5) seeking permission to go abroad w.e.f. 05.09.2024 to 20.11.2024. 2.

At the outset itself, the learned counsel for the petitioner submits that, the petitioner had to visit abroad (Canada) to meet his son, besides visiting abroad (U.S.A.) to meet his pregnant daughter, whose expected date of delivery was 07.09.2024, however, since the said delivery date has already elapsed and his daughter has already been blessed with a child, therefore, the said cause of action does not survive any longer, and as such, he does not want to press the instant petition at this stage. However, he seeks liberty to, post the framing of charges, DEVINDER YADAV 2024.10.22 16:06 I attest to the accuracy and authenticity of this order/judgment

CRM-M-43346-2024 (O&M) approach the learned trial Court concerned, with an application alike to the one enclosed in Annexure P-5.

Consequently, the instant petition is dismissed, as not pressed, but, with liberty (supra).
