As observed, on the last date of hearing, none had appeared on behalf of the respondent. Even today, none has made appearance on behalf of the respondent. As such, the respondent is proceeded against ex parte. Counsel for the applicant heard.
The applicant-wife has filed the present application for seeking transfer of the petition under Section 9 of the Hindu Marriage Act, filed by respondent-husband bearing No.HMA-98-2025, titled 'Parminder Singh vs. Amanpreet Kaur', which is pending in the Family Court, Kapurthala and she seeks transfer of the same to the Court of competent jurisdiction at Balachaur, District SBS Nagar.
It is submitted by learned counsel for the applicant that marriage between the parties to the lis, had taken place on 11.04.2011 and one son born from the said wedlock, who is aged about 7 years, is in the VINEET GULATI 2025.11.14 10:23 I attest to the accuracy and authenticity of this document Chandigarh
TA-947-2025 -2care and custody of the applicant. However, on account of matrimonial dispute, the parties are residing separate. On query, it is submitted that the applicant has no source of earning and she, together with her minor son, is dependent upon her parental family. The distance between the two places is stated to be 126 kms. Even, the applicant has got registered FIR No.47 dated 30.03.2025 at Police Station City Balachaur, which is pending investigation.
Considering the aforesaid circumstances, more particularly, applicant herself having no source of earning and also taking care of minor son as well as considering the distance between the two places and above it, the respondent not having come forward to resist the present application, the transfer application, as such, is hereby allowed and the petition under Section 9 of the Hindu Marriage Act, filed by respondent-husband bearing No.HMA-98-2025, titled 'Parminder Singh vs. Amanpreet Kaur', stands transferred from the Family Court, Kapurthala, to the Court of competent jurisdiction at Balachaur, District SBS Nagar. The requisite record of the aforesaid case be sent by the Family Court, Kapurthala, to the District and Sessions Judge, SBS Nagar.
Learned District and Sessions Judge, SBS Nagar, shall assign the said petition to the Family (Camp) Court, Balachaur. Even, the parties are directed to appear before the Family (Camp) Court, Balachaur, within a period of one month from today onwards.
