The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to the respondent to release her widow pension along with other benefits in accordance with the Employees Provident Fund and Miscellaneous Provisions Act, 1952 (for short, '1952 Act') and Employees Pension Scheme, 1995 (for short, '1995 Scheme').

The petitioner claims that she is widow of Balram who passed away on 31.12.2018 in harness. She in terms of 1952 Act read with 1995 Scheme submitted papers with respondent-authority claiming pension and other benefits. CWP-21944-2024 papers on the ground that there is deficiency. The petitioner has removed all pointed out deficiencies and re-submitted papers on 02.05.2024, however, respondent is sitting over the matter. The petitioner is having two minor daughters and is in dire need of financial assistance. 3.
Notice of motion.

Mr.Rajesh Hooda, Advocate, accepts notice on behalf of the respondent and waives service. He submits that the competent authority would look into the matter and pass an appropriate order. 5.
Considering the relief claimed and status of petitioner, the present petition stands disposed of with a direction to the respondent to pass an appropriate order within three weeks from today. If the order is not passed within aforesaid period, the official concerned would be subjected to costs of Rs.25,000/-.
