The landowners are in appeal seeking enhancement of compensation for the acquired land.

Briefly, the facts are that vide notification dated 9.1.2009, issued under Section 4 of the Land Acquisition Act, 1894 (for short, 'the Act'), the State of Haryana sought to acquire land in the revenue estate of Village Brah Kalan, Tehsil and District Jind, for construction of extension of Brah Kalan Minor from RD 9000 to 15600/Tail off taking at RD 41900/L Jind Distributory No.4 in village Brah Kalan. The same was followed by notification dated 3.7.2009, issued under Section 6 of the Act. The Land Acquisition Collector (for short, the Collector") vide its award dated 28.1.2010 assessed the market value of the acquired land @ ` 8,00,000/- per acre. Dissatisfied with the award of the Collector, the landowners filed objections. On reference under Section 18 of the Act, the learned Court, vide award dated 5.11.2012, assessed the market value of the acquired land @ ` 10,00,000/- per acre. This award has been impugned by the landowners before this Court.

Learned counsel for the State very fairly submitted that the claim made in the present appeal is squarely covered by the judgment of this court in RFA No.826 of 2014-Raghbir and others Vs. State of Haryana, SHARMILA 2015.09.14 18:04 I attest to the accuracy and authenticity of this document.

RFA No. 362 of 2014 (2) decided on 11.9.2014, whereby compensation for the land acquired vide same notification was assessed @ ` 11,04,000/- per acre. For the detailed reasons recorded in Raghbir's case (supra), the present appeal is disposed of in the same terms. As none has appeared for the appellants, copy of the order be sent to the appellants.
