After arguing for some time, learned counsel for the parties are ad-idem that the order of remand dated 16.08.2023 (Annexure P-4) passed by the Appellate Authority envisaged under the Maintenance & Welfare of Parents & Senior Citizen Act, 2007 (for short the 2007 Act) to the Maintenance Appellate Tribunal may kindly be set-aside but the respondents herein, who are appellant before the Appellate Authority be given liberty to make an appropriate representation on the merit of case including the prayer as to whether the respondents/appellant can be allowed to lead evidence at the appellate stage or not.

Learned counsel for the parties further submits that in case any application is moved by either party, an appropriate reply to the said application will be made by the other party before the Appellate Authority for the consideration of the Appellate Authority and for passing appropriate appropriate order on any such application moved. 3.

Keeping in view the joint agreement between the parties, the RIYA 2025.07.25 17:55 I attest to the accuracy and integrity of this document

CWP-20323-2023 (O&M) -2impugned order dated 16.08.2023 (Annexure P-4) is hereby set-aside and the Appellate Authority is directed to decide the appeal filed by the respondents herein (appellant before the appellate Authority) in accordance with law. 4.

It is made clear that this Court is not making any observation either on the merits of the case or any application to be moved by either of the parties which will be within the jurisdiction of the Appellate Authority to decide the same in accordance with law.

As the issue involved in the present petition is with regard to the reversion of the property to the senior citizen, who is quite aged, the Appellate Authority is requested to decide the appeal within the period of three months from the date of first hearing of the appeal fixed before the Appellate Authority i.e. 02.08.2025. Parties are directed to appear before the Appellate Authority on 02.08.2025.

The present petition is disposed of in above terms. 7.

Pending civil miscellaneous application, if any, stands disposed of.
