This revision petition has been filed under Article 227 of the Constitution of India for issuing appropriate directions to the Family Court, Hisar, to expedite the trial and decide the matter, i.e., petition under Section 13 of the Hindu Marriage Act, 1955, filed by the petitioner/husband. 2.
A perusal of the short orders passed by the Family Court, placed on record as Annexure-P/3, shows that after filing of the petition, the respondent/wife appeared on 12.10.2020 and was permitted to engage a counsel to contest the case. She also filed an application for maintenance pendente lite under Section 24 of the Hindu Marriage Act, 1955. Thereafter, the case has been repeatedly adjourned over a period of two years on account of non-filing of written statement by the respondent/wife as well as reply to the application for maintenance by the petitioner/husband. Even after about ten opportunities, written statement has still not been filed by the respondent/wife and the case stands adjourned to 7.12.2022 for the purpose. 4.
In this view of the matter, it is apparent that the case is being tried in a very casual manner by ignoring the mandate of Section 21 B of the ASHWANI KUMAR 2022.10.18 09:49 I attest to the accuracy and integrity of this document
CR No. 4430 of 2022 Act of 1955. The Family Court is, therefore, directed to speed up the trial and conclude the same expeditiously without affording unnecessary adjournments to the parties.
