HARSH BUNGER, J. (ORAL) Prayer in the present petition, filed under Section 482 of the Code of Criminal Procedure is for setting aside/quashing of impugned order dated 11.07.2022 (Annexure P-15) passed by Additional Sessions Judge, SAS Nagar (Mohali), vide which, order dated 21.06.2022 (Annexure P-11) was made absolute subject to provisions contained in Section 438(2) of the Code of Criminal Procedure, in case FIR No.0121 dated 15.06.2022 (Annexure P-9), registered under Section 4(1), 21(1) of the Mines and Mineral (Regulation) of Development Act, 1957 and under Section 379 of the Indian Penal Code, registered at Police Station Thana Sadar, Kharar, District SAS Nagar (Mohali).

At the very outset, learned counsel for the petitioner submits that he may be permitted to withdraw the present petition with liberty to approach the Sessions Court, at the first instance.
