Bhagwani Devi And ORS v. Narain And ANR
RSA-1044-2013 (O&M)
IN THE HIGH COURT OF PUNJAB AND HARYANA AT
CHANDIGARH RSA-1044-2014 (O&M) Date of Decision: May 07, 2018 Bhagwani Devi and others ...Appellants
Versus
Narain and others
...Respondents
CORAM:
HON'BLE MR. JUSTICE ARUN PALLI
Present:
Mr. Madan Gupta, Advocate, for the appellants.
Mr. Rajesh Lamba, Advocate, for respondent No. 1.
ARUN PALLI, J. (ORAL) Having lost before both the Courts below, the plaintiffs are in second appeal. Concededly, in a suit filed by them, they prayed for a declaration that they have perfected their title by prescription/adverse possession. On being pointedly asked, as to how such a suit would at all be maintainable, for, such a plea could only be set up in defence, learned counsel for the appellants fails to point out any such provision or precedent in this regard.
That being so, no question of law, least any substantial question of law arises for consideration. The appeal being devoid of merit, is dismissed.
