The limited question for which the appellant has come up before this Court for cancellation of bail granted to respondent No.2 vide order dated 11.04.2023 passed by this Court, is that without taking permission of the Court, the accused has travelled abroad.

Mr. Naresh Gopal Sharma, Advocate has put in appearance on behalf of respondent No.2 and submits that it was only due to mis-communication and they have never intended to violate the order passed by this Court. He then submits that the respondent No.2 would return back positively as early as possible but not later that 31.12.2023. It is further submitted that in case, respondent No.2 fails to return back by the date fixed by this Court, then the State may proceed to cancel his passport. Given such specific assurance by respondent No.2, he is directed to return back to India on or before 31.12.2023 positively and appear before the concerned police station. Failing which, State shall file an application for cancellation of bail and also for cancellation of passport. It shall also be permissible for the complainant to also file necessary application.
