(ORAL) The petitioner seeks regular bail in FIR No. 25 dated 26.4.2019 under Sections 420, 120-B, 201 IPC, Section 66-D of Information Technology Act and Sections 204, 467, 468, 471 IPC (added later on) registered at Police Station Cyber Cell, Gurugram, District Gurugram. Learned counsel for the petitioner submits that there is no document indicating that the petitioner was running the present company and moreover, in the statement of the employees, recorded by the prosecution agency, they have specifically stated that the petitioner worked as a Team Leader and has nothing to do with the fake company. Learned State counsel, who is assisted by the learned counsel for the complainant, submits that there are specific allegations against the petitioner and he had a fake sim card and a mobile. CRM-M No. 40911 of 2019 -2The petitioner has been in custody since 10.6.2019. No financial benefit has been drawn by the petitioner being the team leader and was an employee of the company. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
