Petitioners Surender Pal and Soran Singh, working as Water Pump Operators (WPO's) in Haryana Shehri Vikas Pradhikaran (HSVP), by way of filing the present writ petition against their such employer and its officers carve for issuance of direction to respondents to re-fix their monthly wages in the pay scale of category 'C' initially instead of category 'D' and to modify their nomenclature from Water Pump Attendant to Water Pump Operator. According to the petitioners, they had got served a legal notice dated 27.5.2021 (Annexure P-14) upon the respondents before filing of the writ petition but that has not evoked any response, as such they have filed the present writ petition.

At the very outset learned counsel for the petitioners has contended that the petitioners would be satisfied if a direction is issued to respondent No. 3 to consider the legal notice got served by the petitioners upon the respondents and then to take appropriate action in the matter. CWP No.25210 of 2021 well as prayer made by the petitioners, for the purpose of enabling respondents to consider the claim of petitioners and then to take appropriate action, if need be and further to avoid unnecessary litigation, the writ petition is disposed of directing respondent No. 3 to dispose of the legal notice of the petitioners in accordance with law, rules, regulations and instructions on the subject within a period of two months from the date of receipt of copy of the order and if some action in the matter is warranted then the needful be done in accordance with law. A speaking order in that regard be passed, which be conveyed to the petitioners as per Registered A.D. Post.
