(ORAL) The present petition has been filed by the petitioner under Section 439 of the Code of Criminal Procedure, 1973, for grant of bail pending trial in case FIR No.34 dated 16.03.2021 registered under Sections 22 of the NDPS Act, 1985 at Police Station Nathana, District Bathinda. Pursuant to the order dated 06.04.2022, affidavit of Rashpal Singh, PPS, Deputy Superintendent of Police, Sub-Division, Bhucho, District Bathinda, on behalf of respondent-State filed in Court today, is taken on record.

A perusal of the file shows that the petitioner was granted interim bail vide order dated 06.04.2022. There is no allegation that the petitioner has misused the concession of interim bail in any manner whatsoever. In view of the above, it would not be appropriate, at this belated stage, to put the petitioner in custody. Therefore, this petition is allowed. Interim bail granted vide order dated 06.04.2022 passed by this Court, is made absolute.
