Present petition under Section 438 Cr.P.C. for seeking pre-arrest bail to the petitioner, namely Balwinder Singh, Sharandeep Singh and Sukhwinder Singh in cross case bearing GD No. 25 dated 03.07.2019 recorded in case FIR No. 45 dated 02.07.2019, registered under Section(s) 323, 324, 148 & 149 IPC (Section 326 IPC was added lateron) at Police Station Tibber, District Gurdaspur.

Learned counsel for the petitioners contended that petitioners have already joined the investigation and no recovery of weapon was to be effected from them. Thereafter, Section 326 IPC was added and even interim relief was granted to them after adding of Section 326 IPC as well and still petitioners are apprehending their arrest in the case. Criminal Misc. No. M-40826 of 2019 already joined the investigation and no recovery of any weapon is to be effected from them and they are not required for further investigation. As such, present petition stands accepted and in the event of arrest of the petitioners, they shall be released on interim bail to the satisfaction of the Investigating Officer. The petitioners will join the investigation as and when called for and shall also abide by the conditions as specified under Section 438(2) Cr.P.C.
