(ORAL) Learned counsel for the petitioner submits that the petitioner being 80% handicap had sought indulgence of this Court regarding her transfer from Karnal to Tarori and in those proceedings direction was issued to frame a policy qua handicap persons. The petitioner was accordingly retained at Karnal. She was astonished to notice that on portal she has been held eligible for transfer. Accordingly, in this regard representation dated 13.07.2019 (Annexure P-17) has been submitted to respondent No.2Director Elementary Education, Haryana, which is still pending consideration.

Without going into the merits and demerits of the claim of the petitioner, I deem it appropriate to direct 2nd respondent-Director Elementary Education, Haryana to consider the representation dated 13.07.2019 (Annexure P-17) within a period of two months from the date of receipt of certified copy of this order and shall pass a speaking order thereon, failing which respondent No.2 shall be liable to pay costs of `25,000/- to the petitioner. This condition of imposing costs is only to prevent petitioner to run from pillar to post and avail remedy of contempt in PANKAJ KUMAR 2019.09.27 15:29 I attest to the accuracy and integrity of this document

CWP No.27296 of 2019 (O&M) -2case of non-compliance of directions issued by this Court. Till then, petitioner shall not be forced to give her option for transfer.
