By filing the present appeal, the landowner is seeking enhancement of compensation for the acquired land. Briefly, the facts of the case are that vide notification issued on 29.3.1996, under Section 4 of the Land Acquisition Act, 1894 (for short, `the Act'), State of Haryana sought to acquire land measuring 23.84 acres situated within the revenue estate of village Gurgaon, Tehsil and District Gurgaon, for development and utilization thereof as Sector 2, 3 road at Gurgaon. Notification under Section 6 of the Act was issued on 30.3.1996. The Land Acquisition Collector (for short, 'the Collector') vide his award dated 31.3.1997 assessed the compensation @ ` 11,73,000/- per acre for Chahi land; ` 6,12,000/- per acre for Magda and Banjar land and ` 31,28,000/- per acre for Gair Mumkin kinds of land.
Dissatisfied with the award of the Collector, the land owner filed objections. On reference under Section 18 of the Act, the learned court below while relying upon the judgment of this Court in RFA No.416 of 2004, Tej Wati and others v. State of Haryana and others, decided on 5.2.2014, assessed the market value of the acquired land @ ` 270/- per square yard. Learned counsel for the appellant did not dispute the fact that the amount of compensation awarded to the landowner for the acquisition of land, is in terms of the judgment of this Court in Tej Wati's case (supra), which attained finality.
