Counsel for the appellant would contend that even though the claimant could not prove the income of the deceased, yet the Tribunal ought to have assessed the same in term of minimum wages notified by the State on the relevant date. Tribunal erred in taking the income of the deceased as merely Rs.4,000/- per month, which is even less to the minimum wages notified for the relevant period i.e., Rs.5,639.50/- per month. 3.
Counsel for the respondent does not dispute that on the relevant date, the notified minimum wages by the State under the statute were Rs.5,639.50/- per month. Accordingly, the impugned award is modified to the extent that the wages drawn by the deceased are taken to be Rs.5,700/- per month. 40% of the future prospects, need to be added. Deduction of 1/2 needs to be applied. Multiplier of 18 has been aptly applied by the Tribunal. Claimant is further awarded an amount of Rs.18,000/- under the head of transportation. Rest of the award is maintained. 4.
With the aforesaid modification in the impugned award, the instant appeal is disposed off.
