The petitioner has filed the present petition under Article 226 of the Constitution of India with a prayer to issue a writ in the nature of Habeas Corpus to search the alleged detenue namely Gurkiranjit Kaur and to get her released from the alleged illegal custody of the private respondent.

In compliance of the order dated 02.08.2025, respondent No. 3 has produced the alleged detenue namely Gurkiranjit Kaur before this Court today.

I have interacted with her, and she submits that she is aged about more than 17 years but is a minor. She further submits that she is a student of 12th Class. She further submits that she wants to marry the private respondent, however, at present, she is willing to go with the present petitioner, i.e. her father.

In view of the statement made by the alleged detenue Gurkiranjit Kaur, her custody is handed-over to Sarabjit Singh, petitioner, who is father of the alleged detenue. 5.
