The petitioner through instant petition under Articles 226/227 of the Constitution of India is seeking direction to respondent No. 2 to issue him passport.

The petitioner vide application dated 19.07.2023 has applied for passport. An FIR No. 90 dated 23.12.2020, under Sections 323, 325, 341, 506, 148 and 149 of IPC was registered against the petitioner at Police Station, Handesra, District SAS Nagar. The police has found him innocent in the investigation. The petitioner is not involved in any other offence still passport authority is not issuing him passport. Learned counsel for the petitioner submits that case of the petitioner is squarely covered by judgment of this Court in Mohan Lal @ Mohna vs. Union of India and others 2023 SCC Online P&H 1391. 4.

Mr. Deepanjay Sharma, DAG, Punjab, who on advance is present in Court, on instructions from ASI Avtar Singh, confirms that petitioner has been found innocent in afore-stated FIR and cancellation report would be filed in due course.

Learned counsel for Union of India, who on advance notice is present in Court, submits that petitioner may be directed to appear before the passport authority alongwith requisite documents and the passport authority, thereafter, would pass an appropriate order after considering the afore-stated judgment within six weeks.

Learned counsel for the petitioner agrees to the aforesaid arrangement.

The petitioner is directed to appear before the passport authority on 05.10.2023 alongwith requisite documents. On doing so, the passport authority would pass an appropriate order, in accordance with law, within six weeks from 05.10.2023.

The petition stands disposed of.
