5! may be considered for the grant of regular bail. He further submitted that one of the other co-accused, namely, Anoop Singh @ Anoop has been extended the benefit of regular bail by this Court vide CRM-M30043 of 2023 on 05.07.2023 and so far as the present petitioner is concerned, he is at a much better footing as compared to the aforesaid co-accused. 3.

On the other hand,  #    $ %

 has stated that it is correct that the petitioner has already faced incarceration for about 1 year and 1 month and he is not involved in any other case and his name was nominated on the basis of " # of a coaccused. He has however submitted that since the recovery from the other coaccused was 325 grams of heroin, the petitioner does not deserve the concession of regular bail.

I have heard the learned learned counsel for the parties. 5.

The petitioner is stated to be in custody for about one year and one month and there was no recovery effected from the petitioner even as per the learned counsel for the parties. The name of the petitioner was nominated on the basis of "

to learned State counsel as to whether any other sufficient material was available to connect the petitioner with the present offence except for the " # of the co-accused, he did not state anything. T! !4 ""

" The other co-accused, namely, Anoop Singh @ Anoop has already been extended the benefit of regular bail by this Court and the petitioner is rather at better footing as compared to the aforesiad co-accused. 6.

In view of the aforesaid facts and circumstances, this Court deems it fit and proper to grant bail to the petitioner. 7.
