NAMIT KUMAR J. (Oral) The petitioners have filed an application i.e. CM No.15234CWP-2024, under Order 6 Rule 17 read with Section 151 CPC for amendment of the pleadings of the main writ petition. On oral request made by learned counsel for the petitioners, the main writ petition, which is fixed for hearing on 28.11.2024, is taken on Board today itself.

Prayer in this writ petition filed by the petitioners under Articles 226/227 of the Constitution of India, is for issuance of a writ in the nature of certiorari, for setting-aside the order dated 05.02.2024 (Annexure P-9), passed by respondent No.2. CWP No.21850 of 2024 (O&M) an SIT in order to conduct proper and fair investigation/re-investigation regarding the irregularities in the recruitment process initiated vide Advertisement No.01/2023 dated 28.01.2023, issued by respondent No.3, for the posts of Firemen and Drivers/Operators (Annexure P-1). Further prayer has been made to direct respondents No.1 to 7 to consider all the necessary documents including the videography of the physical measurement and efficiency test conducted from 18.10.2023 to 23.10.2023 and experience certificates/letters of the driver/operators and also verify the medical fitness certificates of all the selected candidates during the investigation/re-investigation and to direct respondent No.7 to conduct/monitor the investigation/re-investigation regarding the irregularities in the aforesaid recruitment process by any Center Government Agency and further to direct respondents No.1 to 3 that no adverse action be taken against the petitioners by respondents. 2.

After arguing the case for sometime, learned counsel for the petitioners wishes to withdraw the main writ petition as well as the application i.e. CM-15234-CWP-2024 for amendment of main writ petition, with liberty to file a fresh petition on the same cause of action with better particulars, in accordance with law. 3.
