Vs State of Punjab

CORAM:HON'BLE MS. JUSTICE JAISHREE THAKUR

Present:

Mr. Vikas Bali, Advocate for the petitioner.

Mr. Davinder Bir Singh, DAG, Punjab.

-.- JAISHREE THAKUR J. (ORAL) This is a petition that has been filed under Section 438 Cr.P.C. for grant of anticipatory bail for offence under Section 363 IPC. Learned counsel for the petitioner herein would contend that the police were raiding his premises, which necessitated filing of the said anticipatory bail application before the Sessions Court, which was rejected, despite the fact that it is a bailable offence. Learned counsel appearing on behalf of the respondent-State submits that the instant petition itself is not maintainable, as the offence for which the FIR has been registered is a bailable offence. I have heard learned counsel for the parties and have found that the instant petition is not maintainable. However, the petitioner is entitled to seek remedy as available to him in accordance with law. With the aforesaid observation, the instant petition stands disposed of.
