(Oral) CM-19470-CII-2023 The instant application has been filed on behalf of the appellant through Shri Gurpreet Singh, Partner of M/s Yadwinder Rice Mills, who is appearing in person, seeking permission to withdraw the main case i.e. FAO5600-2018, which is presently fixed for 14.3.2024, as the dispute between the parties is stated to have been compromised.

It is specifically stated in para No.3 of the application that the appellant has paid the entire amount which had been settled and that the respondent - department has also issued a No Objection Certificate (NOC) dated 5.10.2023. A copy of the said NOC has also been passed on to this Court, which is taken on record.

CM-19470-CII-2023 in/and FAO-5600-2018 (O&M) ( 2 ) 2023:PHHC:137183 Shri Gurpreet Singh, partner of M/s Yadwindra Rice Mills, who is present in Court, is identified by Mr. Rahul Sharma, Advocate. A perusal of the aforesaid NOC dated 5.10.2023 shows that the said NOC has been issued conditionally by imposing a condition that the appellant would be bound to withdraw all of his cases within a period of 30 days from issuance of said letter.
