Mr. Rajesh Gaur, Additional Advocate General, Haryana. MANJARI NEHRU KAUL, J. (ORAL) Petitioner is seeking the concession of anticipatory bail under Section 438 of the Cr.P.C. in case FIR No.547 dated 26.07.2023 under Sections 323, 34, 346 of the Indian Penal Code, 1860, (Section 306 of the IPC added later on) registered at Police Station Indri, District Karnal.

While issuing notice of motion on 13.09.2023, following submissions of learned counsel for the petitioner were recorded:- "While drawing the attention of this Court to the allegations levelled in the FIR in question, learned counsel for the petitioner submits that the ingredients to invite the mischief of offence under Section 306 of the IPC is clearly amiss in the case in hand." 3.

Thereafter, vide order dated 19.12.2023, the petitioner had been granted interim anticipatory bail with direction to join investigation.

Learned State counsel, on instructions, does not dispute the factum of the petitioner having joined investigation and cooperated with the investigating agency. On further instructions, this Court has been informed by the learned State counsel that a cancellation report has also been filed in the instant case. He on further instructions submits that the petitioner is not required for further investigation much less for his custodial interrogation.

In view of the above, the petition is allowed and interim order dated 19.12.2023 is made absolute subject to the conditions laid down in Section 438(2) Cr.P.C.
