)')*"  +  +,-)'..-)'$/   - "8.In view of the above, it would be appropriate to dispose of the present petition with the following directions: i) State of Punjab is directed to ensure that whenever a complaint is made which reflects commission of cognizable offence, an FIR ought to be registered in terms of the law laid down by the Apex Court in Lalita Kumari's case (supra).

 ii) The provisions of the PreConception and Pre Natal Diagnostic Techniques Act, 1994 be followed in its letter and spirit."

'/ )')5   - "3. That a representation dated 13.05.2025 made by Jameet Singh/petitioner was received in the office of Deputy Inspector General of Police, Faridkot on 16.05.2025 vide Memo No.1773, claiming Jameet Singh son of Bikker Singh is working as Raj Mistri/Mason and is carrying on construction at the house of Gurtej Singh son of Niranjan Singh and while doing said work, Jaideep Singh, who is nephew of Gurtej Singh and is also a neighbor of Gurtej Singh alongwith one Jaswant Singh had stopped petitioner from carrying on construction and utter derogatory words against caste of petitioner & one Husandeep Singh (Mason) on 10.05..2025 and said representation with regard to claims of petitioner was marked by office of DIG, Range Faridkot to the office of SSP, Faridkot vide Memo No.907/FDR/P.C, dated 19.05.

 G.O's i.e. S.P (HQ), Faridkot & DSP (Homicide), Faridkot and said committee of G.O's conducting enquiry into representation of petitioner.

P (HQ), Faridkot after associating/recording statements of (1) Gurtej Singh son of Niranjan Singh, (2) Husandeep Singh son of Roshan Singh, (3) Nacchatar Singh son of Gurdev Singh, (4) Paramjeet Singh son of Beant Singh, (5) Yadwinder @ Babla son of Gurnam Singh, (6) Darshan Singh son of Niranjan Singh and after considering facts & circumstances and CDR (Call Details Record) of Jaswant Singh, enquiry committee concluded that Jaideep Singh is nephew of Gurtej Singh and Gurtej Singh is constructing/renovating his house adjoining house of Jaideep Singh and due to said construction, a property dispute cropped between Gurtej Singh & Jaideep Singh and petitioner was employed as Mason/Raj Mistri at house of Gurtej Singh for carrying out said construction work and in order to pressurize Jaideep Singh, said representation has been got moved by Gurtej Singh through Jameet Singh/petitioner and no independent witness in order to corroborate uttering of remarks against caste of Jameet Singh (petitioner) & Husandeep Singh was mentioned nor was brought as a witness and only Gurtej Singh who is nursing grudge against Jaideep Singh had recorded his statement.

Further CDR of Jaswant Singh was obtained during enquiry and on 10.05.2025, location of Jaswant Singh was not found at Dana Romana i.e.

& devoid of any truth and has been given to pressurize Jaideep Singh. The copy of Enquiry Report dated 16.07.2025 of S.P (HQ), Faridkot is attached herewith as Annexure R1/Τ.

That since no offence was found to be made out on the facts submitted in representation made by petitioner, concluded by enquiry committee of two G.O's i.e. S.P (HQ), Faridkot & DSP (Homicide), Faridkot, thus, said representation was ordered to consigned, as no further action was required to be initiated." *   " 6 &'
