Mr. Pawan Singh, Advocate for respondent No.4. DEEPAK GUPTA , J.(Oral) Appearance has been made on behalf of respondent No.4. Status report on behalf of the respondent-State has already been received. Paragraph Nos.5 and 6 of the said report is reproduced as under:- "5. That during enquiry statement of witnesses namely Rajesh son of Daya Nand resident of Santor whose name has been mentioned by the petitioner in his complaint dated 07.08.2023 and Kartar son of Rishal resident of Imlota (father of respondent Kailash) were recorded and both of them have stated that Kailash has purchased the Bolero Camper vehicle in the name of petitioner Dharmender and later on due to greed, petitioner refused to hand over the vehicle to Kailash and thus Kailash stopped paying the loan installments.

The matter was solved in a local panchayat organized in the house of petitioner Dharmender on 19.07.2023 and subsequently, on 21.07.2023 petitioner Dharmender has given an affidavit regarding ownership of the Bolero vehicle in the name of respondent Kailash stating that Kailash is at liberty to get the vehicle transferred in his name.

6. That during the course of enquiry the matter was found to be of financial transaction between the petitioner and respondent Kailash. No threat was found to be issued to the petitioner by the SARITA RANI 2023.12.04 17:20 I attest to the accuracy and integrity of this document/order

CRWP-9160-2023 - 2 - private respondents either. Hence, no cognizable offence was found to be made out in the matter and both the complaints after due enquiry has been filed. Hence, the present petition is liable to be dismissed."

In view of the aforesaid status, no direction is required to passed from this Court. This petition is hereby disposed of with liberty to the petitioner to avail alternate remedy available to him, in case he is not satisfied with the status report.
