The present petition has been filed under Section 482 CrPC for issuance of direction to the respondents to conduct fair re-investigation in FIR No.100 dated 08.06.2018 under Sections 323, 354, 316 and 506 of the Indian Penal Code, 1860 (Section 316 IPC stands deleted) and Section 12 of the Protection of Children from Sexual Offences Act, 2012, registered at Police Station Pinangwan.

As per status report filed by way of affidavit of Usha, HPS, Additional Superintendent of Police, Nuh the challan qua the petitioner was presented on 30.01.2019 and supplementary challan was presented on 30.05.2019. The trial is in progress and 11 prosecution witnesses have also been examined.

Faced with the same, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to avail his remedies as available in law.
