ARVIND SINGH SANGWAN, J. (Oral) Prayer in this petition is for issuance of directions to the official respondents to decide the representations (Annexure P-10 and P-11) filed by the petitioner and not unnecessarily harass the petitioner with a further prayer to protect the life and liberty of the petitioner and his family members.

As per the allegations in the petition, one Jaswant Kaur was Sarpanch of Gram Panchayat, Gilzian and the petitioner was a Member of the Panchayat during that tenure of 2003-2008. The petitioner, on account of certain misuse of the grant had given a complaint to the Block Development Panchayat Officer, Tanda Block in which the Sarpanch was held guilty and was directed to deposit some amount in the Gram Panchayat fund. Thereafter, the Panchayat Secretary, ADC Development, Hoshiarpur, on a complaint given, also held him guilty along with the Sarpanch. CRM-M-48965-2019 -2It is further stated in the petition that on account of the said complaint he is now receiving threats, though he is holding a PR of Canada, he has to visit frequently to Canada and apprehends that he may be involved in some serious offence, like NDPS..

The complainant has given a complaint to the senior police official and his grievance is that the same may be decided. Reply by way of affidavit of Deputy Superintendent of Police, Special Branch, Hoshiarpur is on record and as per the reply, it is stated that the Senior Superintendent of Police, has not received the representation filed with the petition as Annexure P-10. However, the application (Annexure P-11) was received through Home Department and an enquiry was conducted by the Deputy Superintendent of Police, Tanda, District Hoshiarpur and after conducting the enquiry, the same was found to be false and frivolous and, accordingly, it was filed. As the petitioner is residing abroad and the police authority has not found any threat to his life and liberty, no further action is called for and the present petition stands disposed of, accordingly.
