ASHOK KUMAR VERMA, J. (ORAL) Prayer in this criminal writ petition filed under Section 226 of the Constitution of India, is for issuance of a writ in the nature of Habeas Corpus for releasing the detenue from the illegal custody of respondents No. 4 and 8 and to direct respondents No. 2 and 3 to take appropriate action against them.
Pursuant to the order dated 22.11.2022, reply dated 17.12.2022, by way of affidavit of Sh. Hamendra Kumar Meena, Additional Superintendent of Police, Meham, District Rohtak along with copy of statement of detenue-Monika (Annexure R-1), had already been filed. In her statement recorded under Section 164 Cr.P.C., detenueMonika, stated that petitioner used to threaten her to kill her brother and force her to marry. The petitioner solemnized marriage with her at Panchkula and also taken protection from Court. CRWP-9783-2022 -2liquor and opium and did not allow her to talk with her family member. She further stated that she does not want to go with the petitioner and is happily living with her parents.
In view of the above and averments made in the reply, no further action is required to be taken in the instant writ petition and the same stands dismissed.
