(Oral) Prayer in the present petition filed under Section 438 of the Code of Criminal Procedure, 1973 is for grant of anticipatory bail to the petitioners in case FIR No.106 dated 19.08.2019 under Sections 406 and 498-A IPC registered at Police Station Women Cell, Sector 17, Chandigarh.
Petitioner no.1 is husband whereas petitioner no.2 is motherin-law of the complainant-respondent no.2. Vide order dated 25.09.2019, while issuing notice of motion in the case, arrest of the petitioners was stayed. Thereafter, vide order dated 01.10.2019, the matter was referred to the Mediation and Conciliation ASHWANI KUMAR 2019.11.29 18:29 I attest to the accuracy and integrity of this document
Criminal Misc. No. M-41259 of 2019 -2Centre of this Court and the parties were directed to appear before it on 23.10.2019.
Pursuant thereto, report dated 27.11.2019 has been received from the Deputy Registrar, Mediation and Conciliation Centre to the effect that the parties have settled their disputes by way of amicable settlement and a separate settlement/compromise deed dated 25.11.2019 has been signed by the parties.
Mr. Raman Mahajan, counsel for the petitioners, has handed over a bank draft of Rs.2,00,000/-, in the name of respondent no.2, in Court in terms of settlement/compromise deed dated 25.11.2019, to counsel for respondent no.2.
Mr. Krishan Singla, Advocate has put in appearance on behalf of respondent no.2 and filed his vakalatnama in Court, which is taken on record. He has admitted the very factum of execution of the compromise deed between the parties.
In view of the settlement having entered between the parties, the order, whereby arrest of the petitioners was stayed, is hereby made absolute. In case the petitioners are required in the case in any manner, a clear 15 days notice be given to them.
Accordingly, the present petition is disposed of with a direction that the parties shall adhere to the settlement/compromise deed in letter and spirit.
