This is a petition filed under Section 438 Cr.P.C. seeking anticipatory bail in case FIR No.407 dated 09.06.2023, under Sections 420, 467, 468, 471, 457, 380, 411 and 120-B IPC, registered at Police Station City Palwal, District Palwal.

Learned counsel for the petitioner inter alia submits that the petitioner has been falsely implicated in the present case. It is submitted that the alleged occurrence is of 20.04.2023 and on the same set of facts pertaining to the said incident, another FIR No.301 dated 04.05.2023 (Annexure P-3) was registered after an unexplained delay Neha 2024.01.24 17:45 I agree to specified portions of this document

2024:PHHC:009864 CRM-M-46262-2023 -2especially when the possession of the premises was already taken on 03.06.2023. It is submitted that the petitioner is ready and willing to join investigation and abide by any stringent terms and conditions that may be imposed by this Court.

Notice of motion, returnable for 23.11.2023.

Ms. Ambika Sood, Addl. A.G., Haryana, accepts notice on behalf of respondent-State and waives service. She opposes the present petition and seeks time to file reply/status report.

In the meanwhile, petitioner shall join the investigation and would associate as and when called. In the event of arrest, the petitioner shall be admitted to interim bail on his furnishing personal bond and surety to the satisfaction of Arresting Officer/Investigating Officer. The petitioner shall abide by the conditions specified in Section 438(2) Cr.P.C.  Learned State counsel has filed status report on behalf of the respondent-State and the same is taken on record. She, on instructions from ASI Lakshman, at the very outset, informs the Court that the petitioner has joined the investigation and his custodial interrogation is not required. 1 ):
