***** ARCHANA PURI, J. (Oral) The present appeal has been filed by the appellant-Ramesh Chand, thereby questioning the adequacy of compensation awarded by learned Motor Accident Claims Tribunal, on account of injuries sustained by him, in a motor vehicular accident, which took place on 27.12.2015. However, during the pendency of the FAO, counsel for the Insurance Company has made an offer, for enhancement of compensation, to the extent of Rs.2,50,000/-, over and above the amount awarded to the appellant, by learned Tribunal. This offer is acceptable to the counsel for the appellant.
Perusal of the impugned Award reveals that an amount of Rs.3,19,450/-, was awarded as compensation by learned Tribunal. The disability certificate of the appellant was proved in evidence, which is Sonu 2025.12.10 16:27 I attest to the accuracy and authenticity of this document
FAO-5958-2018 (O&M) Ex.PW2/A and the same depicted the disability to the extent of 30%. While considering the salary of the deceased to be Rs.31,067/-, compensation was assesed by learned Tribunal, as evident from paragraphs No.28 and 29 of the impugned Award.
In the light of the aforesaid and also in view of the offer made by the counsel for the Insurance Company, which is acceptable to the counsel for the appellant, the FAO is hereby accepted and an amount of Rs.2,50,000/- over and above the awarded amount, is awarded to the appellant. The requisite amount shall be payable by the Insurance Company, by way of cheque in the name of the appellant, within a period of 45 days, failing which, the Insurance Company shall be liable to pay penal interest @ 8% per annum, till realization.
