The petitioner through instant petition under Article 226 of the Constitution of India is seeking direction to respondents No. 1 and 2 to reissue his passport. 2.

The petitioner was issued passport on 27.11.2013 which is valid upto 26.11.2023. The petitioner went to UAE to earn his livelihood. The petitioner came to India and solemnize marriage with Tejinder Kaur on 09.02.2014. The petitioner went back to UAE and on account of matrimonial dispute, the wife of the petitioner lodged FIR No. 106 dated 07.12.2018, under Sections 406 and 498-A of IPC, registered at Police Station, Fattu Dhinga, District Kapurthala against the petitioner. The petitioner was declared Proclamation Offender and he filed CRM-M- 26392 PARAMJIT KAUR SAINI 2023.10.10 14:43 I attest to the accuracy and authenticity of this order/judgment

CWP No.20356 of 2023 -2- 2023:PHHC:131173 of 2023 before this Court for setting aside of PO order. This Court vide order dated 24.05.2023 has stayed order dated 29.05.2020 whereby petitioner was declared PO in the aforesaid FIR. The petitioner wants to come to India and join proceedings arising out of aforesaid FIR. The passport of the petitioner has been impounded vide order dated 03.12.2019 passed by Regional Passport Officer, Amritsar. 3.

Learned counsel for the petitioner submits that petitioner is willing to come to India and join the proceedings, thus, he may be issued passport.

Counsel for the Union of India submits that case of the petitioner would be considered for issuing Emergency Travel Certificate and an appropriate order in this regard would be passed within four weeks. 5.

Counsel for the petitioner agrees to the aforesaid arrangement. 6.

In the wake of statements of both sides, the petition stands disposed of.
