Upon instructions, counsel for respondents No.1 to 4 states that the power to appoint the arbitrator under condition 70 of IAFW-2249 (General Conditions of Contracts) has been vested to the Chief Engineer, Headquarters, Western Command, who has to make an appointment. State counsel does not have any instructions regarding conceding to appointment of arbitrator by this Court.

In view of the above, counsel for the petitioner seeks and is granted permission to withdraw the instant petition with liberty to take recourse to the remedy available to the petitioner under Arbitration and Conciliation Act, 1996. 3.

Dismissed as withdrawn with liberty as aforesaid. 4.
