Versus
State of Punjab and another -Respondents CORAM: HON'BLE MR. JUSTICE RAJ MOHAN SINGH
Present:
Mr. Rajinder Sharma, Advocate, for the petitioner.
**** RAJ MOHAN SINGH, J. (Oral) Petitioner has preferred this writ petition for the issuance of an appropriate writ in the nature of mandamus directing the respondent No.2 to decide the legal notice dated 16.09.2022 got issued by the petitioner in respect of approval of time table.
Learned counsel for the petitioner submits that the petitioner was granted a regular stage carriage permit to operate two return trips daily on Rampura to Faridkot via Maur, Talwandi, Rama, Bathinda, Goniana, Baja Khana route by the Regional Transport Authority, Bathinda w.e.f. 28.04.2022. Petitioner has already deposited the requisite expenses towards taxes.
-2Despite grant of regular permit, regular time table has not been approved despite representation/legal notice dated 16.09.2022 got issued by the petitioner.
Learned counsel for the petitioner submits that at this stage, the petitioner would be satisfied in case her legal notice dated 16.09.2022 is directed to be decided by the competent authority/ respondent No.2 by passing a speaking order in accordance with law at the earliest.
Notice of motion.
On the asking of the Court, Mr. Sanjeev Soni, Addl. A.G., Punjab accepts notice on behalf of the respondents and submits that due to some omission, monopoly route was granted to the petitioner and now the same is sought to be cancelled by the competent authority by issuing notice to the petitioner.
This fact has been refuted by learned counsel for the petitioner.
Be that as it may, in view of nature of controversy, it would be just and appropriate to direct the respondent No.2 to take note of pending legal notice got issued by the petitioner and pass appropriate order in accordance with law, preferably within a period of one month from the date of receipt of certified copy of this order.
