ARVIND SINGH SANGWAN J. (Oral) Prayer in this petition is for issuance of direction to the official respondents to hand over the investigation of FIR No.34 dated 29.06.2019 registered under Sections 308, 323, 341, 506, 427, 148, 149 IPC at Police Station Dharamgarh, District Sangrur to any other independent agency outside District Sangrur.

Counsel for the State has argued that in the FIR, 18 persons were nominated as an accused out of which 10 persons have already been arrested and 08 persons were found innocent and subsequently Section 308 IPC was deleted after obtaining the opinion of the medical board and now the investigation against the persons arrested in the case has been completed and the challan will be presented before the Illaqa Magistrate within a period of 08 weeks from today.

In view of the above, this petition is disposed. However, liberty is granted to the petitioner to revive this petition in case the challan is not presented on or before 15.04.2020 before the Illaqa Magistrate.
