Tribhuvan Dahiya, J (Oral) This petition has been filed under Article 227 of the Constitution of India for setting aside order dated 03.10.2022 (Annexure P-14), whereby the interim direction granted vide order dated 08.09.2022 (Annexure P-12) to GMADA, directing it not to issue any NOC till the next date of hearing, i.e., 30.09.2022 has not been extended. Learned counsel states that an application moved by the petitioner under Order XXXIX Rules 1 and 2 CPC is fixed for hearing before the trial Court on 13.12.2022. Till then the interim direction issued by the trial Court vide order dated 08.09.2022, restraining issue of NOC may be ordered to be extended.

Since the application for interim injunction is already filed by the petitioner under Order XXXIX Rules 1 and 2 CPC and the same is AVIN KUMAR 2022.11.15 09:38 I attest to the accuracy and integrity of this order/judgment.t

CR No.4637 of 2022 [2] fixed for hearing before the trial Court, there is no ground to interfere with the impugned order and to issue the directions sought. Dismissed.
