(ORAL) Prayer in this petition under Section 439 read with Section 482 Cr.P.C., is for grant of interim bail to the petitioner in case FIR No. 413 dated 22.07.2022 registered under Section 20 of the NDPS Act at Police Station Industrial Sector-29, Panipat, for one month in order to seek medical treatment as he is suffering from paralytic attack in both leges due to which there is numbness in both legs and he is also suffering from mental disorder.

Upon notice, status report dated 4/7.11.2022, has been filed by way of affidavit of Sh. Devi Dayal, Superintendent, District Jail, Panipat. In para 3 of the status report, it has been averred that petitioner was suffering from paralysis in both lower limbs and left upper limb for which he took treatment from private practitioner at Devband Road, Rampur Maniharan, District Saharanpur (U.P.). CRM-M-47530-2022 -2in jail, the patient was fully recovered from this ailment and was physically fit. On 21.09.2022, the petitioner visited the Jail Hospital, for pain in left leg and treatment for the same was provided. Now, he has fully recovered from the illness.

In view of the above, learned counsel for the petitioner submits that she may be permitted to withdraw the instant petition. Dismissed as withdrawn.
