(Oral) Prayer in this petition filed under Section 528 of the Bharatiya Nagarik Suraksha Sanhita, 2023, is for quashing of FIR No.0163 dated 03.05.2024 registered under Sections 406, 420 IPC and Section 24 of Immigration Act, at Police Station Pundri, District Kaithal (Annexure P-1) on the basis of compromise dated 12.07.2024 (Annexure P-2), arrived at between the parties. Vide order dated, 05.09.2024, notice of motion was issued in the instant petition and the parties were directed to appear before the learned trial Court/Illaqa Magistrate/Duty Magistrate to record their respective statements with regard to the compromise. CRM-M-43783-2024 Thereafter, a report dated 19.10.2024, has been received from the learned trial Court, wherein it has been specifically stated that the matter stood compromised between the parties. On 04.11.2024, learned counsel appearing for respondents No.2 and 3 stated that petitioners have not honoured the terms of compromise regarding handing over of money and the cheques, handed over by the petitioners were dishonoured.

The order dated 04.11.2024, reads as follows:- Status report filed by learned State counsel is taken on record, copy thereof supplied to opposite counsel. Learned counsel representing respondent Nos.2 and 3 stated that petitioners have not honoured the terms of compromise regarding handing over of money. In fact the cheques handed over by the petitioners were dishonoured. Learned counsel representing the petitioners seeks some time to verify the aforesaid fact.

Adjourned to 19.12.2024.

Since, the terms and conditions of the compromise arrived at between the parties have not been honoured, no ground to entertain this petition is made out.

Dismissed.
