Instant petition has been filed under Section 483 of BNSS, 2023, for grant of regular bail to the petitioner, who has been booked for having committed the offence punishable under Sections 302, 341 & 34 of IPC and Sections 25/54/59 & 27 of Arms Act (Sections 307, 201, 149, 109 and 120-B of IPC, were added later on), in FIR No.15, dated 24.01.2020, registered at Police Station City-2 Malerkotla, District Sangrur. 2.

At the outset, reply dated 15.01.2026, filed by way of affidavit of the Additional Public Prosecutor, Malerkotla, has been filed by the learned State counsel in Court today. The same is taken on record. A copy thereof has been handed over to the counsel opposite. 3.

As per the aforesaid reply, learned State counsel submits that out of total 28 prosecution witnesses, 02 witnesses have died, 10 witnesses have been given up, and 14 witnesses have already been completely examined before the learned trial Court. As of now, only 02 prosecution witnesses remain to be examined.

For reference, paragraph No.3 of the aforesaid reply reads as under:- "3.

That it is respectfully submitted with regard to the total witnesses JAWALA RAM 2026.01.28 11:24 I attest to the accuracy and authenticity of this document

CRM-M-40219-2025 - 2 - in the trial related to present petition, it is respectfully submitted that a total of 28 witnesses were to be examined out of which two witnesses have been died and 10 witnesses have been given up and 14 witnesses have been completely examined in the learned trial court. That only 2 witnesses have been left to be examined out of whom PW-10 SI Satwinder Singh has been completely examined in chief and his cross examination was deferred on the request of the learned defence counsel and another witnesses PW8 Inspector Deepinderpal Singh (IO) is partly examined in chief and remaining examination in chief was deferred for the want of case property." 5.

In view of the stage of the trial, as informed by the learned State counsel, I refrain from dealing with the prayer for bail at this stage. 6.

Accordingly, the present petition stands disposed of without making any observations on merits.

However, noticing that the petitioner has already undergone incarceration for a period of more than 06 years (as stated by petitioner's counsel), the learned trial Court is directed to make all endeavours to conclude and decide the trial expeditiously, preferably within a period of next three months.

Let a copy of this order be forwarded to concerned trial Court for compliance.
