***** RAJ MOHAN SINGH, J .(Oral) Petitioner seeks grant of regular bail under Section 439 Cr.P.C in case bearing FIR No.366 dated 04.12.2014, registered under Sections 307, 506, 148 and 149 of IPC (Section 302 IPC added later on) at Police Station Focal Point, District Ludhiana.

In CRM-M No.27850 of 2019 titled 'Amarjit Singh Vs. State of Punjab', this Court passed the following order:- "The prayer in this petition is for grant of concession of regular bail to the petitioner in case FIR No.366 dated 04.12.2014, registered at

CRM-M No.43307 of 2019 (O&M) -2Police Station Focal Point, Ludhiana, under Sections 307, 506, 148, 149 IPC (Section 302 IPC added later on).

Learned State counsel on instructions from ASI Satnam Singh has submitted that the prosecution evidence is likely to be concluded on 26.07.2019.

Since it is submitted that the petitioner has been in custody for more than 41⁄2 years having been arrested on 10.12.2014, the trial Court will ensure that the trial is concluded expeditiously and preferably within two months from today.

In view of the above, the present petition is disposed of as not pressed at this stage."

Thereafter, prosecution filed an application under Section 311 Cr.P.C for summoning of Record Keeper of Rajendera Medical College, Patiala and the said application was allowed by the Trial Court on 29.10.2019.

The trial was delayed on account of that reason but the order dated 29.10.2019 has attained finality. Out of 23 prosecution witnesses, all have been examined. The case is fixed for 11.02.2020 for examination of summoned witness i.e. Record Keeper which was allowed to be examined by the Trail Court vide order dated 29.10.2019.

CRM-M No.43307 of 2019 (O&M) -3This petition is disposed of with a direction to the Trial Court to conclude the trial either on the date fixed or soon thereafter in view of order dated 10.07.2019 already passed in CRM-M No.27850 of 2019 titled 'Amarjit Singh Vs. State of Punjab'. In case, the trial is unnecessary delayed, the petitioner would be having a right of consideration of his regular bail in accordance with law.
