In view of the peculiar facts and circumstance of the present case whereby not only the trial has been delayed, because of non appearance of the PWs but is also case where as per the affidavit filed by SSP it nowhere mentions that the police vehicle was not belonging to their Department. At the cost of repetition, this Court is again clarifying that this Court does not wish to make any observations on the merits of the case but it is only for the purpose of considering the grant of bail of the petitioner, at this stage, the aforesaid peculiar facts and circumstance would lead this Court to have a prima facie view of this case %5! ) !% ! % 5 ! !
