(Oral) The present petition has been filed under Section 482 Cr.P.C. for quashing of FIR No.42 dated 01.03.2016 under Sections 420, 406 of IPC at Police Station Mukerian, District Hoshiarpur. None has put in appearance on behalf of the petitioner. Similar was the situation of the last date of hearing. Learned counsel for the State has pointed out that 2 out of the 39 prosecution witnesses already stand examined. In view of the fact that the trial is proceedings and disputed questions of fact have been raised in the present petition which cannot be adjudicated in summary proceeding under Section 482 of Cr.P.C. I find no merit in the present petition and the same stands dismissed. However, the petitioner would be at liberty to raise all the grounds, raised in the present petition before the Trial Court at the appropriate stage.
