****** DEEPAK GUPTA, J. (ORAL) By way of this second peon filed under Secon 439 Cr.P.C., peoner prays for grant of regular bail in case FIR No.63 dated 02.05.2021 under Secons 22(c) of NDPS Act, 1985, registered at Police Staon Nathana District Bathinda, Punjab.

While dismissing the earlier peon on 07.02.2024, it was noced by this Court that peoner was in custody for the last 02 years, 09 months and 02 days and by that me 05 out of 18 witnesses had been examined. However, considering the huge quanty of contraband allegedly recovered from the peoner and co-accused, and at the same me considering the custody period, the trial Court was directed to expedite the trial. Today it is informed by learned State counsel that out of 18 witnesses cited by the prosecuon, 09 have been examined and 06 have been given up. Learned State counsel submits that although 03 witnesses are le@ as per the list of witnesses but in case truck owner appears on the next date of hearing, there will be no need to examine any other witnesses except that truck owner.

Having noced all the aforesaid facts and circumstances, this Court is not inclined to grant the regular bail to the peoner as trial appears to be near PRIYANKA 2024.12.05 16:04 I attest to the accuracy and integrity of this document

CRM-M-43985-2024 -2conclusion. At the same me, trial Court shall make sincere efforts to expedite the trial as early as possible.
