(Oral) This is the second petition filed under Section 439 Cr.P.C seeking grant of regular bail to the petitioner in case FIR No.70 dated 02.06.2019 registered under Sections 376-D, 376-A of Indian Penal Code, 1860, Section 6 of the Protection of Children from Sexual Offences (POCSO) Act, 2012 (Sections 376-A, IPC was deleted, Sections 4 and 17 of POCSO Act, 2012 were added later on) at Police Station Sarangpur, District U.T.Chandigarh (Annexure P-1).

At the outset, counsel for the petitioner submits that since there is change in the circumstances, after dismissal of the previous petition, he may be granted permission to withdraw the petition with liberty to approach the Sessions Court.
