The instant petition has been filed by the petitioner for a direction to the respondents No.2 and 3 for conducting fair and impartial investigation in a case arising out of FIR No. 51 dated 29.06.2025, under Sections 118(1), 115(2) and 3(5) of the Bharatiya Nyaya Sanhita, 2023. The redressal of grievance of the petitioner can be recorded by the Court of learned Judicial Magistrate. Otherwise also, as per the contents of the petition, the opposite party has committed an offence and cognizance of the same can be taken by the learned Area Judicial Magistrate. 2.

In such circumstances, the instant petition is hereby dismissed with liberty to the petitioner to file a complaint before the Court of learned Judicial Magistrate.
