(ORAL) Having suffered concurrent adverse findings by the two Courts below, appellant-plaintiff is in second appeal before this Court assailing learned trial Court judgment and decree dated 21.07.2012, as upheld by learned First Appellate Court vide its judgment and decree dated 06.04.2013, dismissing suit for permanent injunction filed by plaintiff.

Learned counsel for appellant though appears, but on being asked to argue, he fairly concedes that he has not been in touch with appellant over the years and pleads lacks of instructions, on the other hand, none appears for the respondents. It seems that by sheer pendency of appeal, parties to the lis have reconciled their differences.

Be that as it may, instant appeal is dismissed for non-prosecution. 4.
