ARVIND SINGH SANGWAN, J. (Oral) Prayer made in the petition is for grant of anticipatory bail to the petitioner in case FIR No.85 dated 28.8.2019 under Section 420 IPC and Section 13 of the Punjab Travel Professional (Regulation) Act, 2014, The Prevention of Human Smuggling Act, 2012 (Old), registered at Police Station Bhikhiwind, District Tarn Taran.

On 26.9.2019, the following order was passed :- "Learned counsel for the petitioner further submits that the entire allegations are against aforesaid co-accused Ramandeep Kaur and Gurmail Singh as well as their daughter Harmandeep Kaur and the amount has been transferred to their account.

Notice of motion for 18.10.2019."

Counsel for the petitioner has handed over two demand drafts amounting to Rs.9,00,000/- and Rs.4,00,000/- (Nos.233636 and 233638 issued by the Oriental Bank of Commerce), respectively to the complainant, who is present in the Court. The photocopy of the same is taken on record. Counsel for the parties submit that the payment made by the petitioner and received by the complainant may be subject to the final outcome of the case.

Learned State counsel submits that the petitioner has joined the investigation and no more required in the case. In view of the same, the present petition is allowed and the order dated 26.9.2019 passed by this Court is made absolute, subject to the conditions envisaged under Section 438(2) Cr.P.C. However, it is made clear that as and when the petitioner is to travel abroad, he will move an appropriate application before the trial Court and the same will be entertained on such terms and conditions as it may deem fit.
